FunctionFit’s (Company) Terms and Conditions are mentioned below and you (reader/visitor) of the website www.functionfit.in is expected to read this page carefully. In case you do not accept the T&Cs, we would request you to exit this site. The company holds the right to modify these Terms and Conditions and therefore we request you to keep yourself updated by visiting this section periodically. These T&Cs are binding on all users of this Website.
Use Of Content
The intellectual property rights for any logos, creatives, pictures, videos, texts, color schemes, names, information etc as available on the website belong to FunctionFit and cannot be used by any individual, group, or entity for any purpose. Except under the licensing agreement with the company.
Acceptable Website Use
Any breach of general Terms and Conditions, spamming, hacking, phishing or any form of cyber crime would be reported and pursued as per the local jurisdiction. No such incidents would be permitted.
Any infringement of the copyright, trademark, wordmark or products or other intellectual property rights will be held liable for suitable legal action by FunctionFit.
Indemnity & Liability
The user/visitor shall be solely responsible for any accidents, hurts, injuries or death etc. which may arise during the conduct of any activity arising from the direct or indirect influence or instructions or the services provided by FunctionFit.
The User also unilaterally agrees to indemnify and hold harmless, without objection, the Company and its office bearers such as employees and directors from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of FunctionFit (www.functionfit.in) or their breach of the terms.
Additionally, the Company and its office bearers are absolved of any liabilities in the form of damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent. It also includes any extraordinary and uncertain events such as lockdown or natural calamities.
Refund And Cancellation
- Membership Fees once paid will not be refunded by FunctionFit under any circumstances whatsoever.
- FunctionFit reserves the right to “TERMINATE A MEMBERSHIP” as and when the management deems.
- Payments made availing any Offer will not be refunded or transferred under any circumstances.
General Terms & Conditions
- ALL MEMBERSHIPS ARE NON-TRANSFERABLE & NON-REFUNDABLE
- The membership is personal, and cannot be shared
- The Member has to confirm that he/she is 16 years old or older. For persons 15 or below, membership is granted only with written parental consent
- Online memberships will not have extension provision for any reason whatsoever
Code of conduct and Suspension/Termination Of Membership
This place does not and shall not discriminate on the basis of race, color, religion, caste, gender, gender expression, age, disability, marital status or sexual orientation. We thrive on mutual respect, equality and progressiveness. Any case of discrimination must be reported immediately to the management.
If the Member (client) behaves in an inappropriate way that goes against acceptable code of conduct such as harassment of staff of FunctionFit the membership can be suspended or terminated at management’s sole discretion without any warning.
FunctionFit is a private fitness entity and management reserves the right to refuse membership to any individual without stating the cause.
Authorship
FunctionFit may take videos and pictures of its members to put up on social media. FunctionFit is entitled to repost any images that are related to the workout for commercial and promotional purposes. The parties in the images will not be compensated for such promotions.
Refunds
FunctionFit has a strict “no refunds” policy in place. Members cannot cancel their membership after purchase.
